6 Each Party shall provide that in civil judicial proceedings concerning the enforcement of intellectual property rights, its judicial authorities shall have the authority to order the infringer to provide, for the purpose of collecting evidence, any information that the infringer possesses or controls regarding any person or persons involved in any aspect of the infringement and regarding the means of production or distribution channel of such goods or services, including the identification of third persons involved in the production and distribution of the infringing goods or services or in their channels of distribution, and to provide this information to the right holder or the judicial authorities. 6

15 자료를 저장 · 출력시 전문적인 컴퓨터 기술 및 프로그램 사용 디지털 증거의 수집과 분석에 포렌식 전문가가 필요 디지털 자료를 확인시 그에 적절한 소프트웨어가 필요 새로운 소프트웨어로 과거 소프트웨어나 하드웨어를 분석할 수 없는 경우가 있음 반복된 복사 과정에서 질적 저하 없음 내용이 동일해도 복사되거나 새로 저장되었을 경우 증거로서의 가치가 달라질 수 있음 15
