3 2. 물품의 하역과 장치 어느 나라나 무역상품은 개항으로 반출입. 외국무역선(기)에서 하역된 외국물품은 보세구역이 아닌 장소에 장치불가 하역 화물이 주로 반입되는 보세구역 : 보세창고, 지정장치장 무역실무에서는 CY, CFS, 선사 또는 항공사 창고로 불려짐 CY : FCL 화물을 취급 CFS : LCL 화물을 취급 기타 하역된 화물이 반입 가능한 장소 (우리나라의 경우) 보세구역 : 보세공장, 보세건설장, 보세판매장, 보세전시장, 세관검사장, 종합보세구역 유사 보세구역 : 보세구역외장치장, 자유무역지역 개항지역 이외에 소재하는 장소로 반입에는 보세운송이 필요 화물상황은 관세청 홈페이지를 통해 실시간으로 파악가능 My presentation consists of five parts. 종류 : 수출용보세공장, 내수용보세공장, 겸용보세공장 보세전시장 박람회, 전시회 등을 위해 외국물품을 장치하거나 사용 보세전시장 반입가능 물품 : 전시장 건설용 물품, 전시장 업무용품, 전시용품, 판매용품, 관람자에게 기증할 물품 등 보세건설장 외국물품인 기계류, 설비품, 공사용 장비를 사용하여 건설공사를 진행한 다음 나중에 관세 등을 납부 My presentation consists of five parts. 보세판매장 구매가능 금액은 $3,000 이나, 귀국시 면세한도는 1인당 $400이 한도 종합보세구역 보세창고, 보세공장, 보세전시장, 보세건설장, 보세판매장의 기능 중 둘 이상의 기능을 종합적으로 수행할 수 있는 장소 자유무역지역 관세법상 보세구역은 아니나, 입주기업은 외국물품을 보세상태에서 사용하여 생산활동 시설재도 보세상태로 사용 가능한 점이 보세공장과 차이 My presentation consists of five parts. 7 6. 보세구역외 장치장 개 념 수입신고 건별로 세관장의 허가를 받아 보세구역 외에 통관시 까지 외국물품을 장치(6월 범위내 세관장이 기간지정) 물류의 신속, 물류비의 절감 측면에서 의미 주요 허가대상 부피가 매우 큰 경우 등 특수성이 있어 창고내 장치가 곤란한 물품 다량의 산물(예 ; 무연탄, 곡물 등) 부패, 변질 우려 등이 있어 방습, 냉동 등이 필요한 물품 귀중품, 의약품, 산 동물 등 보세구역 장치가 곤란한 물품 중계무역물품으로 보세구역 내에서 보수작업이 곤란한 물품 무역계약과 상이한 물품으로서 수출하고자 하는 물품 My presentation consists of five parts. 8 7. 보세구역 장치화물의 특성 보세상태에 있는 동안은 관세 및 내국세의 부과가 유보되고, 수출입요건의 충족여부 등이 문제되지 아니함 무역계약에 따른 대금결제조건의 이행등과는 별개 보세상태에서 화주는 현품의 확인이 가능 : 필요시 세관장의 허가를 받아 반송, 폐기 등의 조치도 가능 세관장의 허가를 받을 경우 견품의 반출도 가능 보세구역 장치중인 화물의 소유권 혹은 점유권은 무역거래조건에 따라 결정 : 화주가 각종 권리와 의무의 주체 거래에 의해 화주는 변경될 수 있으며, 이 경우 계약서 등 입증서류가 있으면 수입통관, 반송 등이 가능 My presentation consists of five parts. 부산항, 인천항, 인천공항, 김해공항의 지정장치장에 반입한 물품 : 2월(2월내 연장가능) 보세창고 일반적인 경우 6월(6월내 연장가능) 부산항, 인천항, 인천공항, 김해공항의 보세창고(CY, CFS, ODCY 포함)에 반입한 물품 : 2월(2월내 연장가능) 기타 보세구역 : 특허기간내 보세구역외 장치허가 물품 : 6월 범위내 세관장지정기간(연장가능) My presentation consists of five parts. 10 9. 체화물품의 처리 수출, 수입 또는 반송할 것을 통보
체화되면 통보 후 1월 이내 통관할 것을 요청. 소재 불명시 공고로 갈음 매각공고 : 공매물품, 수량, 공매예가 등을 매각개시 10일전까지 공고(관세청 홈페이지 및 신문광고, 게시판 게시 등) 매각 : 일반경쟁입찰, 지명경쟁입찰, 경매, 수의계약, 위탁판매 등(위탁판매처 : 한국보훈복지의료공단)매각 매각되지 않을 경우 1주일 간격으로 5회 동안 재공매 실시 매각대금의 충당 : 매각비용, 관세, 기타 제세 순으로 충당 충당 후 남은 금액은 화주에게 교부 반출통고 및 국고귀속 : 매각이 안될 경우 지체없이 반출을 통고하고, 반출하지 않을 경우 국유화 조치 My presentation consists of five parts. 보세운송신고인 : 당해 물품의 화주, 관세사, 보세운송업자 보세운송 신고와 승인 원칙적으로 신고로 가름하나, 관세청장이 따로 정한 물품에 대해서는 세관장의 승인이 필요 신고 혹은 승인에 대해 별도의 수수료는 부과되지 않음 부두직보세운송제도, 보세구역도착전 신고제도 등과 연계한 물류대책의 필요 My presentation consists of five parts.
